1. Ms. Smriti, learned counsel for the applicant has claimed parity with co-accused Kishan Kumar Tiwari, who is stated to have been granted bail by a co-ordinate bench of this Court and his earlier two bail applications were rejected.

To the contrary, Shri Pradeep Kumar Shukla, learned counsel for the informant/complainant submits that the trial has almost concluded and the evidence of prosecution as well as of the defence has already been completed before the trial court and the case was listed for hearing of arguments. On which date an adjournment application was moved by counsel of the applicant and on that application date of 07.09.2024 has been fixed and the applicant's counsel has also been subjected to cost. It is submitted that delaying tactics are being adopted by the applicant and he cannot take benefit of the same.

1. Let this case be listed on 12.09.2024, by which date, the parties may bring on record any documents through supplementary affidavit or supplementary counter affidavit, which they feel would be in their support.
