Heard learned counsel for the applicant, learned AGA and perused the record.

The applicant seeks enlargement on bail in FIR No.415 of 2023, under Section 302, 201, 34 IPC, P.S. Kasimpur, District Hardoi.

It is argued that the co-accused with similar allegations, has been enlarged on bail vide order dated 20.03.2024 passed in Criminal Misc. Bail Application Nos.2738 of 2024.

Learned AGA has opposed the bail application.

Considering the reasoning as contained in the order of the coaccused coupled with the fact that the applicant has no criminal history and is in custody since 07.10.2023, the applicant is entitled to be enlarged on bail on the ground of parity. In view thereof, the application is allowed.

Let the applicant -Karan Pasi be released on bail in aforesaid first information report number subject to his furnishing a personal bond and two reliable sureties of Rs.20,000/- (Rs. Twenty Thousand) each of the like amount to the satisfaction of the court concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;

(b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and

inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
