Heard Mrs. Smriti, learned counsel for the applicant and learned A.G.A for the State.

Learned counsel for the applicant has filed a rejoinder affidavit which is taken on record.

Learned A.G.A has informed that only three fact witnesses have been examined till date. He has further submitted that there are some fact/relevant witnesses, who should be examined otherwise if the applicant is granted bail, he would influence the fact/material witnesses after releasing from jail.

Having considered the aforesaid submission of the learned A.G.A, the learned trial court is directed to examine all the fact/relevant witnesses with expedition taking recourse to Section 309 Cr.P.C by fixing short date if possible on day to day basis ensuring that no unnecessary adjournment shall be given to any of the parties, if any party does not cooperate in the trial proceedings, the appropriate coercive steps shall be taken. It is expected that the aforesaid relevant prosecution witnesses would be examine within a period of two months, failing which this bail application may be disposed of on the next date.

List this case on 26^th September, 2024 within top ten cases.

Let the copy of this order be provided to the learned trial court through District and Session Judge, Lakhimpur Kheri, by registry of this Court within three working days for its compliance.
