Heard learned counsel for petitioner and learned State Counsel for opposite parties 1 and 2.

Issue notice to opposite party no.3 by normal mode as well as Dasti which shall be issued expeditiously by office upon payment of usual charges.

Petition has been filed challenging order 11.01.2024 whereby Deputy Registrar, Lucknow has referred the matter pertaining to petitioner-society under Section 25(1) of Registration of Societies Act, 1860 prima facie finding a dispute regarding Committee of Management.

Learned counsel for petitioner submits that the Deputy Registrar has totally lost sight of the fact that opposite party no.3 is in fact a fake and unregistered Society which is being conducted misutilising the name of petitioner-society and its registration number. It is submitted that earlier also petitioner had filed Regular Suit no. 548 of 1998 and Regular Suit no.28 of 1999 against office bearers of opposite party no.3. Aforesaid Regular Suits were decreed vide judgment and order dated 20.03.2003. Appeal and Writ Petition thereagainst were also rejected.

It is submitted that aforesaid facts have not been taken into consideration by authority concerned and there is not even any subjective satisfaction recorded in the order pertaining to any dispute of the Society.

Prima facie, submissions advanced by learned counsel for petitioner appear to have force and require consideration for which opposite parties are granted four weeks' time to file their counter affidavit.

List this case on 19.04.2024.

¶12

Affidavit of service shall be filed on or before the next date of listing.

Till the next date of listing, operation of impugned order dated 11.01.2024 shall remain stayed.
