Heard learned counsel for the applicant as well as learned AGA for the State and perused the record.

This is 2nd application for bail moved on behalf of the applicant- Awadhesh in Crime/FIR No.0188 of 2023, under Sections 363 and 366 IPC lodged at Police Station Purwa, District Unnao as his earlier bail application bearing Criminal Misc. Bail Application No.12337 of 2023 is still pending before this Court.

It appears that in the first bail application filed on behalf of the applicant bearing criminal misc. bail application no. 12337 of 2023 the applicant was granted interim bail vide order dated 22.12.2023 and said bail application was directed to be listed in the 1st week of April, 2024. Thereafter, the charge-sheet appears to have been filed amongst other under Sections 363 and 366 IPC also and it is in this background probably due to some misconception this fresh bail application has been filed by the applicant, seeking bail in same crime/fir no.0188 of 2023, under Sections 363 and 366 IPC. Without going into the technicalities as the matter relates to personal liberty of an accused person and considering that this is the second application for bail moved on behalf of the applicant- Awadhesh in this crime number as his earlier bail application bearing criminal misc. bail application no. 12337 of 2023 is still pending before this Court, this bail application may be connected with Criminal Misc. Bail Application No.12337 of 2023.

Thus, instant bail application is connected with the earlier bail application i.e. Criminal Misc. Bail Application No.12337 of 2023 and the record of both these bail applications may now be placed before the appropriate Bench, if possible in the next week (week commencing Feb. 19, 2024) and, if in this regard any order is required, the same may be obtained from Hon'ble Chief Justice/Hon'ble Senior Judge.
