Heard learned counsel for the applicant as well as learned A.G.A. and perused the record.

It is argued by the counsel for the applicant that the co-accused has already been enlarged on bail vide order dated 12.07.2024 passed in Criminal Misc. Bail Application No. 15208 of 2023 (Meera Vs. State of U.P.), as such, the applicant may also be enlarged on bail on the ground of parity.

Learned A.G.A. opposed the bail prayer but could not dispute the parity.

Considering the allegation against the applicant to be similar to the coaccused coupled with the fact that the applicant is in custody since 17.10.2020 and the trial has not even started, the applicant is enlarged on bail. Accordingly, the bail application is allowed.

Let the applicant Amitabh Kumar Srivastava @ Amitabh Srivastava be released on bail in FIR/ Case Crime No. 163 of 2020, under Sections 409, 420, 467, 468, 471, 120-B IPC, Police Station Gomti Nagar, District Lucknow, on his furnishing personal bonds and two reliable sureties of Rs.20,000/- each to the satisfaction of the court concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;

¶12

(b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and

¶13

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
