1 . Heard learned Counsel for the petitioner.

2 . The present petition has been filed with the following prayer:

"I. direct the leaned Civil Judge (Junior Division), Court No. 13, Barabanki to decide the application for framing and proper issues under Order 14 Rule 5 of the Civil Procedure Code, filed by the petitioner which is number as C-143 dated 06.03.2021 in Regular Civil Suit No.497 of 1998 (Govind Prasad Vs. State of U.P. through District Magistrate Barabanki & others) before further proceeding of the suit for the evidence of defendants."

3 . Considering the relief as sought, the present petition is disposed off directing the court concerned to consider and decide the aforesaid application in accordance with law with all expedition preferably within a period of two months from the date of production of a certified copy of this order.
