This Court passed the following order on 17.10.2024:-

"Heard, Shri Suyash Gupta, learned counsel for the applicant, Shri Deepak Singh, Advocate holding brief of Shri Indu Prakash Singh, learned counsel for respondent no.1 and Shri Vipul Shukla, learned counsel for respondent no.2.

This is an application for appointment of the substitute Arbitrator under Section 11(6) of the Arbitration and Conciliation Act, 1996.

This court by means of the order dated 20.12.2023 passed in Civil Misc. Arbitration Application No.43 of 2020; A2Z Green Waste Management Ltd. Versus C And DS U.P.Jal Nigam, Lucknow and another had appointed Hon'ble Mr.Justice Shailendra Saksena, Former Judge of this Court, Resident of MIG-A, Sector-C, Aliganj, Lucknow as an Arbitrator in the matter to settle the dispute between the parties in terms of agreement dated 16.06.2009.

Learned counsel for the applicant submits that Hon'ble Arbitrator has recused himself to continue as an Arbitrator in the matter and intimated to the parties, therefore a prayer has been made for appointment of substitute Arbitrator.

Learned counsels for the opposite parties does not dispute and that the Hon'ble Arbitrator appointed by this court has recused himself to continue as an Arbitrator in the matter and he has intimated to the parties, therefore substitute Arbitrator may be appointed.

In view of above, with the consent of the learned counsel for the parties, the Court proposes to appoint Hon'ble Mr.Justice Anurag Kumar, (Former Judge of this court), R/o 5/501, Deepak Delux, Shara Grace, Jankipuram, Lucknow, U.P., Mobile No.9415286898 as an Arbitrator to settle the dispute between the parties.

Let a copy of the pleadings on record alongwith the relevant provisions of the amending Act 2015 be sent to Hon'ble Mr.Justice Anurag Kumar, (Former Judge of this Court), R/o 5/501, Deepak Delux, Shara Grace, Jankipuram, Lucknow, U.P., Mobile No.9415286898 for eliciting his disclosure in terms of Section 11(8) read with Section 12(1) of the Act, 1996 and Schedule VI and VII as amended by Act 2015, appended thereto, as also his consent for appointment as an Arbitrator for resolving the dispute.

Learned counsel for the applicant shall supply an additional copy of the application to the office for the said purpose within a week. List after receipt of reply/consent"

In pursuance of the aforesaid order, Hon'ble Mr. Justice Anurag Kumar (Former Judge of this Court) has furnished the disclosures and accorded his consent in accordance with law to be an Arbitrator vide letters dated 15.11.2024 and 04.12.2024.

In view of above Hon'ble Mr. Justice Anurag Kumar (Former Judge of this Court), R/o 5/501, Deepak Delux, Shara Grace, Jankipuram, Lucknow, U.P. Mobile No.9415286898 is appointed as an Arbitrator to arbitrate with regard to the dispute

between the parties herein.

The application is disposed of accordingly.

Office is directed to communicate a copy of this order to Hon'ble Mr. Justice Anurag Kumar (Former Judge of this Court) forthwith.
