Heard Sri Suresh Chandra, learned counsel for the applicant and Sri Birendra Pratap Singh, learned counsel for the State and perused the material on record.

This is third anticipatory bail application of the applicant. The first and second anticipatory bail applications of the applicant were rejected by a co-ordinate Bench of this Court vide orders dated 12.09.2022 and 01.12.2022 passed in Criminal Misc. Anticipatory Bail Application U/S 438 Cr.P.C. Nos. 8048 of 2022 and 10226 of 2022.

This third anticipatory bail application under Section 438 Cr.P.C. has been filed by the applicant- Keshav Deo Chaturvedi, seeking anticipatory bail in Case Crime No. 19 of 2005, under Sections 406, 420, 467, 468, 471, 204, 477-A, 120-B I.P.C. & 13 (1) (D) Prevention of Corruption Act, Police Station Sadabad, District Hathras, during pendency of trial.

The matter has been listed before this Court since vide order dated 02.10.2024 Hon'ble The Chief Justice has directed the matter to be laid / listed before the appropriate Court dealing with such matters.

After arguments at length, learned counsel for the applicant submits that he may be granted liberty to approach the court concerned for filing regular bail application and prays that the present anticipatory bail application be dismissed as not pressed.

As prayed, the present anticipatory bail application is dismissed as not pressed.
