Heard learned counsel for applicant and learned Additional Government Advocate for State as well as perused the record.
The present application for anticipatory bail has been filed by the applicant apprehending arrest in Case Crime No.323 of 2019 under Section 406 IPC, Police Station Cantt., District Faizabad/Ayodhya.
Upon objection being raised by learned A.G.A., learned counsel for the applicant submits that the present anticipatory bail application may be dismissed as not pressed and seeks liberty to file a regular bail application in view of law laid by Supreme Court in order dated 7.10.2021 passed in Petition for Special Leave to Appeal (Cri) No.5191 of 2021 Satender Kumar Antil versus Central Bureau of Investigation and another.
In view of the above, the application is rejected. However, liberty is granted to the applicant to file a regular bail application before the learned trial court, which, if filed, shall be considered and decided strictly in view of the law laid down by Supreme Court in Satender Kumar Antil (supra).
