"Heard learned counsel the applicant, learned counsel for the complainant and learned A.G.A. for the State. The present bail application under Section 438 Cr.PC. has been filed seeking anticipatory bail in case crime/F.I.R No.29/2024, under Sections 447, 120-B, 306 I.P.C., P.S. Gaindas Bujurg, District Balrampur. Learned counsel for the applicant submits that the present F.I.R. has been registered via application under Section 156(3) Cr.P.C. alleging that case of the husband of the informant is going on with Rajesh Verma, Rakesh Verma, Dr. Waris and Dinesh Patel, Lekhpal, Akhilesh Verma, Revenue Inspector, Taffazul have assisted the accused Nos.1, 2, 3 and 6 in taking illegal possession on the land of Gata No.237(?). The lekhpal and the revenue inspector had actively conspired. It is further alleged that the applications were given by her husband to the administration but nothing was done, the incident is of 24.10.2023 at about 10 :00 am with the connivance of accused Nos.4 and 5. It is also alleged that the other accused persons were erecting pillars on the land of the informant and when her husband tried to stop them, they did not stop rather compelled the husband of the informant to commit suicide due to that he committed suicide and set himself on flames. It is further alleged that the accused persons did not try to save him thereafter, he was taken to Balrampur District Hospital from there he was referred to Lucknow. It is further alleged that pressure of the administration was such that focibly her husband was cremated and no demand was made. He was a person of scheduled caste and extremely poor. Learned counsel for the applicant submits that applicant is not named in the F.I.R., he has no criminal antecedent. Applicant was posted as S.H.O. in the concerned police station Gaindas Bujurg. Applicant has been falsely implicated in this case. Applicant has nothing to do in this case. There is no material collected by the prosecution to show that accused was in any way having complicity in the illegal possession of the land of Gata No.237(?) allegedly owned by husband of the informant.
