Applicant-Complainant has filed this application under Section 483 Code of Criminal Procedure for issuance of directions to the trial court to expeditiously conclude the proceedings of Case No. 15165 of 2023; titled State vs. Jitendra Kumar, arising out of Case Crime No. 99 of 2022, under Sections 419, 420 and 406 IPC, Police Station Gulariya, District Gorakhpur, in a stipulated period.
When the case is taken up, no one has put in appearance on behalf of the applicant-complainant.
The charge sheet under Section 173(2) Cr.P.C. against the accused was filed on 5th November, 2022 and after taking cognizance on 24th February, 2023, the accused are yet to appear and the trial court is issuing arrest warrants to secure the presence of the accused.
Therefore, no exceptional ground is made out for expeditious disposal of the subject case.
The application fails and is hereby dismissed.
