Applicant-Complainant has filed this application under Section 483 Code of Criminal Procedure for issuance of directions to the trial court to expeditiously conclude the proceedings of Criminal Case No. 2535 of 2021; titled State vs. Faizi Khan and others, arising out of Case Crime No. 83 of 2021, under Sections 498A, 323, 342, 504, 506 IPC and Section 3/4 Muslim Women Protection of Rights to Marriage Act, 2019 and 3/4 Dowry Prohibition Act, Police Station Kotwali, District Azamgarh, in a stipulated period.
Concededly, the cognizance of offence was taken on 25th July, 2022 and the charges against the accused are yet to be framed.
Thus, it is apparent that the trial in the case is yet to commence. Therefore, keeping in view of the decision of Hon'ble Apex Court in Shaikh Uzma Feroz Hussain Vs. The State of Maharashtra, MANU/ SCOR/ 145020/ 2023, no case is made out for issuing any direction for expeditious disposal of the case.
The application is dismissed.
