In the instant application i.e. APPLICATION U/S 482 No. 7035 of 2024 (Vishal Singh And 5 Others vs. State Of U.P. Thru. Prin. Secy. Home Deptt. Lko. And Another), this Court on 09.08.2024 had passed the following order:-
"List this case on 14.08.2024, as fresh in the list of fresh cases alongwith APPLICATION U/S 482 No. - 4959 of 2024.
It is expected that till the next date of listing, no coercive action shall be taken against the applicants.
It is made clear that on the next date of listing, the case would not be adjourned on any ground including the ground of illness and appropriate orders would be passed in the absence of the learned counsel for the applicants including in the connected case which includes dismissal of the case for want of prosecution.
Learned counsel for the applicants appearing in this case shall communicate this order to the learned counsel for the applicants of the connected case, indicated hereinabove, by WhatsApp/Email/Letter etc."
After the aforesaid order, both the applications were listed on 14.08.2024 and 21.08.2024. On 21.08.2024, on account of paucity of time, the applications were posted for 22.08.2024 i.e. today.
Today, when the case was called out, Bench Secretary of the Court informed that Sri Rajat Pratap Singh, learned counsel appearing for the applicant in connected
application i.e. APPLICATION U/S 482 No. 4959 of 2024 has sought adjournment on account of illness by sending illness slip.
In view of aforesaid as also in the interest of justice, the applications are adjourned for the day.
List/put up both the applications as fresh on 27.08.2024 as a first case of the day.
It is made clear that on the next date of listing, the case would not be adjourned on any ground including the ground of illness and appropriate orders would be passed in absence of learned counsel appearing for the applicant in connected application i.e. APPLICATION U/S 482 No. 4959 of 2024, which includes dismissal of the case for want of prosecution. It is for the reason that law on the subject has already been settled by the Hon'ble Apex Court in various pronouncements.
Interim orders, if any, are extended till the next date of listing in both the applications.
