Learned counsel for the applicant submits that FIR was lodged by the wife of the applicant under section 498-A, 323, 342, 504, 506 Indian Penal Code and Section 3/4 Dowry Prohibition Act. Thereafter the matter was referred to the Mediation Center. Both the parties has arrived at the compromised on 19.3.2019 in which it was settled that the spouse will get their marriage dissolve through mutual divorce and the applicant will pay Rs. 21,50,000/- to Nishu Singh. Out of which as per the agreement Rs.5,00,000/-was paid by the applicant to Nishu Singh on 19.3.2019 through demand draft dated 14.3.2019. Thereafter, mutual divorce petition has been filed under Section 13-B of the Hindu Marriage Act before the Principal Judge, Family Court Lucknow. The compromise was brought into knowledge of the Investigating Officer and consequently Investigating officer has submitted final report. In the meantime, on 2.8.2019 Nishu Singh died in S.G.P.G.I. Lucknow due to her illness and after death when the applicant refused to give Rs.16,50,000/- which were paid to Nishu Singh as one time settlement for her alimony the respondent no.2 father of Nishu Singh got annoyed and has filed the protest petition maliciously
