Applicant has approached this Court through this application under Section 482 Code of Criminal Procedure for issuance of directions to the Additional District and Sessions Judge, Court No.7, Meerut to connect and tried the Sessions Trial No. 136 of 2016, titled State Vs. Irfan and others, and Sessions Trial No. 1171 of 2017, titled State Vs. Asad and another, arising out of Case Crime No. 435 of 2015, under Sections 147, 148, 149, 307, 302, 34 I.P.C., Police Station Sardhana, District Meerut.
Concededly, the second charge sheet against another set of two accused in the same case crime was submitted on 31.5.2016 and the dates of hearing in both trial is fixed for the same day by the same court. Further, it is not disputed by learned counsel that no prayer for clubbing the two cases has been made before the trial court, therefore, this Court is not inclined to exercise the inherent powers under Section 482 Cr.P.C.
The application fails and is hereby dismissed.
