Learned counsel for the applicants submitted that applicant no. 1 is wife of Sandeep Gupta i.e. opposie party no. 2. She got married opposite party no. 2 on 21.11.2021. After the marriage she undergone torture and demand of dowry by her in-laws in the presence of her husband. Consequently, she has lodged a complaint on 1.11.2022 against the opposite party no. 2 and his family members. When the opposite party no. 2 got knowledge of the complaint case lodged by his wife then he also lodged a complaint dated 6.12.2022 with false and exaggeration contention in which the trial court has issued the summoning order dated 4.2.2024. Learned counsel for the applicants further submitted that applicant is sufferer of torture by her husband and in-laws, which has been started by them only within a year of the marriage and just retaliation the present complaint has been lodged against the applicant no. 1, her father, brothers and other closed relative while against them there is no specific allegations in the complaint. Thus, the opposite party no. 2 has lodged complaint just to create pressure upon applicant no. 1 and her family members. Therefore, the proceedings of the complaint case filed by the opposite party no 2 may be quashed.
