Heard Mr. Vidya Sagar Dwivedi, the learned counsel for applicants and the learned A.G.A. for State.

Perused the record.

Applicants-Ahsan Ali And 6 Others, who are charge sheeted accused, have approached this Court by means of present application under Section 482 Cr.P.C. with the following prayer:-

"It, is therefore most respectfully prayed this Hon'ble Court may kindly be pleased to allow this application and to quash the summoning order dated 18.09.2024 as well as entire proceeding of Special Complaint Case No. 617 of 2024 (ws-41/2024) (Ajay Pal (wis-41/24t Vs. Ahsan Ali & others), Under Section 323, 392 I.P.C. Police Station-Sakit, District-Etah, pending in the court of Special Judge (D.A.A.), Etah.

It is further prayed, further proceeding of the aforesaid case be stayed, during the pendency of the present application before this Hon'ble Court, otherwise the Applicants shall suffer irreparable loss and injury.

And/or to pass such other and further order or direction which this Hon'ble Court may deem fit and proper under the facts and circumstances of the case in the interest of justice."

After some arguments, the learned counsel for applicants wants to withdraw the application with liberty to applicants to file a bail application before the court of competent jurisdiction.

In view of above, the application is disposed of as withdrawn with liberty to applicants to appear before court below and file an appropriate application for bail which shall be decided in the light

of decision rendered in Satender Kumar Antil Vs. Central Bureau of Investigation and another (2021) 10 SCC 773 .
