Heard learned counsel for applicant and learned A.G.A. for opposite party No.1-State. In view of order being passed, notice to opposite parties 2 to 6 stand dispensed with.

Application under Section 482 Cr.P.C. has been filed for expeditious disposal of application dated 12th September, 2022 under section 216 Cr.P.C. to add Sections 324/149 IPC in criminal case No. 2239 of 1999 (old case No.269 of 2010) (State versus Mahrule Hasan and others) arising out of case crime No. 62209990075/1999 under sections 147, 148, 149, 323 IPC, P.S. Civil Line, District Aligarh).

It has been submitted that although the aforesaid case is pending since 1999 but after evidence of applicant was concluded in the year 2015, the aforesaid application under section 216 Cr.P.C. has been filed and is still pending consideration for the past two years and therefore directions for its expeditious disposal are required.

Learned A.G.A. does not have any information with regard to current status of trial but admits on the basis of material on record that the applicant's deposition was concluded in the year 2015.

In view of submissions advanced by learned counsel for parties, the trial court is directed to decide the application dated 12th September, 2022 preferred by the applicant under section 216 Cr.P.C. expeditiously, preferably within a period of two months from the date a certified copy of this order is brought on record of proceedings in case there is no legal impediment with regard to same and taking into account the current status of trial.
