Heard learned counsel for applicants and learned Additional Government Advocate appearing for State.

In view of order being passed, notices to opposite party no.2 stand dispensed with.

Application under section 482 Cr.P.C. has been filed quashing the entire criminal proceeding of case no.4728 of 2023 (State versus Arun Ram and others) arising out of case crime No.514 of 2022 under sections 323, 504, 506, 452 IPC against the applicants 1,2 and 3 and under Section 506 IPC against the applicant No.4, P.S. Tarya Sujan, District Kushi Nagar pending in the court of Civil Judge (S.D.), Kushi Nagar at Padrauna.

After arguing the matter at some length learned counsel for applicant s submits that he does not want to press the application and seeks liberty to file bail application before the learned trial court which may be considered and decided in view of law laid by Hon'ble the Supreme Court in the case of Satender Kumar Antil versus Central Bureau of Investigation & Another (Petition for Special Leave to Appeal (Cri) No.5191 of 2021) dated 07.10.2021.

Learned Additional Government Advocate has no objection to the prayer made by learned counsel for applicant.

On due consideration to the submissions of learned counsel for parties, it is provided that in case

applicant appear before the trial court within fifteen days from today and file bail application, the same shall be considered and decided expeditiously in view of law laid down in the case of Satender Kumar Antil (supra).
