Sri Pankaj Lal, learned counsel for the applicants and Sri B.N. Upadhyay, learned A.G.A. for the State are present.
The present application under Section 482 of the Code of Criminal Procedure, 1973 has been filed to quash the entire proceedings of Session Trial No. 897 of 2023, (State of U.P. Vs. Prem Shankar and others) arising out of Case Crime No. 143 of 2018, under Sections 323, 504, 506, 325, 308 of I.P.C., Police Station- Jhunsi, District- Prayagraj, as well as order dated 14.12.2023 whereby the discharge application has been dismissed and order dated 28.11.2023 whereby the charge has been framed.
After some arguments, learned counsel for the applicants does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction.
Certified copy of the order may be returned to the learned counsel for the applicants after retaining a xerox thereof.
In view of the above, the application is dismissed as not pressed with the aforesaid liberty.
