Sri Anjani Kumar Shukla, learned counsel for the applicant and Sri Vijay Kumar Mishra, brief holder for the State are present.
The present application under Section 482 Cr.P.C. has been filed by the applicant with a prayer to issue a direction to the Chief Judicial Magistrate, Aligarh to decide the Case No. 18448 of 2021, (State of U.P. Vs. Kaushar Khan & others) under Sections 406, 420, 504, 506 of I.P.C., Police Station Bannadevi, District Aligharh within stipulated period.
After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction.
Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.
In view of the above, the application is dismissed as not pressed with the aforesaid liberty.
