Heard Sri Kaushal Kumar Sharma, Advocate holding brief of Sri Vinod Kumar, learned counsel for applicants.

I find merit in the argument of learned counsel for applicants that impugned summoning order is an unreasoned order and is squarely covered by the judgment passed by this Court in Application under Section 482 No.9986 of 2024, Seema Devi And14 Others Vs. State Of U.P. And Another Neutral Citation No. - 2024:AHC:119837 , wherein such nature of order has been set-aside since it was passed without application of mind and with closed eyes also. For reference, impugned order is quoted below -:

पररिवनदिपत कदे तथ्यनों एवनां पररिसस्रदतयनों तरन उपलब्ध सनक्ष्य कदे आधनरि परि दवपकलीगण हषर दमशन, प्रखरि दमश, दवमल दमश व रिनकदेश दमश कदे दवरूद्ध धनरिन 232 भिन०दिनां०सनां० कन अपरिनध प् र म दृष्टयन बनतन प्रतलीत हयोतन हहै औरि वह उक धनरिनन्तगरत तलब दकयदे जिननदे ययोग्य हहै।

323 भिन दिनां०सनां० कदे अपरिनध मम जिररियदे सम्मन ददिनननांक 15.07.2024 हदेततु तलब दकयन जिनय। पररिवनदिली दनरिन सलचली गवनहनन प्रस्त त ु करिनदे परि सम्मन दनगरत दकयन जिनय। पहैरिवली अन्दिरि सपनह दकयन जिनयदे।"

In view of above discussion, I find that it is a fit case where inherent powers of this Court could be exercised.

Accordingly, impugned order dated 21.5.2024 passed by Judicial Magistrate, Court No.3, Allahabad in Complaint Case No.4340 of 2022 (Abhishek Kumar Mishra Vs. Harsh Mishra and others) under Section 323 I.P.C. Police Station-Holgarh, DistrictAllahabad is hereby set aside and matter is remitted back to learned Trial Court to pass a fresh order taking note of Seema Devi (supra) .
