Heard Mohd. Akbar Shah Alam Khan, learned counsel for applicants and learned AGA for State.

The present application under Section 482 Cr.P.C. has been filed to set aside/quash the summoning order dated 19.07.2022 passed by learned A.C.J.M. Room No.2, Muzaffarnagar in Complaint Case No.180/09/2022 (Smt. Roshan Vs. Mohd. Akil Khan and others) under Section 406 I.P.C., P.S.- Titawi, Muzaffarnagar, pending in the Court of A.C.J.M., Room No.2, Muzaffarnagar.

Learned counsel for applicants, after arguing for some time, fairly submits that applicants are ready to appear before Trial Court within three weeks and in case any application for bail is filed, the same may be considered and decided in accordance with law taking note of judgment passed by Supreme Court in Satender Kumar Antil vs. Central Bureau of Investigation and another, (2021) 10 SCC 773 .

Learned A.G.A. appearing for State has no objection against the aforesaid prayer.

In view of above, without interfering with impugned order, the application is disposed of with observation that in case applicants appear before Trial Court concerned within three weeks and file bail application, Trial Court concerned shall consider and decide the same in accordance with law, in terms of the judgment passed by Supreme Court in Satender Kumar Antil (supra) , expeditiously, preferably on same day, subject to cause list of concerned Court.
