Sri Pawan Singh Pundir, learned counsel for the applicant and Sri Pusp Raj Singh, brief holder for the State are present.
The present application under Section 482 of the Code of Criminal Procedure, 1973 has been filed to quash the order dated 22.10.2019 passed by Judicial Magistrate, Ist, District Basti in Case No. 20/11 of 2014, (Vyas Singh Vs. Brahmdev & Others) whereby a protest petition arising out of Case Crime No. 781 of 2012, under Sections 419, 420, 467, 471 of I.P.C., Police StationHariyya, District- Basti, whereby the learned Magistrate allowed the final report and dismissed the protest petition in default.
After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction.
Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.
In view of the above, the application is dismissed as not pressed with the aforesaid liberty.
