Learned counsel for the applicant has argued that the victim and her father have made specific allegation that as a result of commission of rape, the victim P.W.2 delivered a child and the similar is the stand of the victim in her deposition before the trial Court as P.W.2. He submits that in her deposition the victim clearly stated that she has no objection if the D.N.A. test is conducted to ascertain the parentage of the child. He has drawn the attention of the Court to the impugned order dated 2.11.2023 to contend that the trial Court has erroneously rejected his application seeking D.N.A. test. Learned counsel has given the copy of the deposition of P.W.2 and he further undertakes to file a typed copy of the said submission.
Issue notice.
At this stage, learned State Counsel prays for time to seek instructions in the matter.
Put up this case as fresh on 16.1.2025.
Meanwhile, final judgement may not be passed in the instant matter.
