Complainant-Revisionist has filed this criminal revision to challenge the order dated 12.1.2024 passed by Additional Civil Judge (J.D.)-Ist/ Judicial Magistrate, Bhadohi, Gyanpur in Criminal Complaint No. 257 of 2019, titled Ashok Kumar Vs. Nitin Kumar and others, under Sections 323, 504 I.P.C., Police Station Gopiganj, District Bhadohi.
During the course of hearing, it is not disputed by learned counsel for revisionist that against the impugned order dated 12.1.2024, the revisional jurisdiction of the High Court has been invoked whereas in view of the nature of offences as well as grievance raised by the complainant, this Court is of the considered opinion that remedy of revision against the impugned order dated 12.1.2024 before the court of sessions would also be equally efficacious.
Thus, the revision petition is disposed of with liberty to the revisionist to challenge the impugned order dated 12.1.2024 before the court of sessions. In case the revision petition is filed in next three weeks, the same be decided in accordance with law, without going into the issue of limitation.
