Sri Viveka Nand Rai, learned counsel for the applicants and Sri P.K. Srivastava, learned A.G.A. for the State are present.
The present application under Section 482 of the Code of Criminal Procedure, 1973 has been filed to quash the entire proceedings of Case No. 78 of 1999, (State Vs. Kali Charan and others) arising out of Case Crime No. 63 of 1998, under Sections 323, 504, 506, 376 of I.P.C., Police Station- Nibohara, District- Agra, pending in the Court of Additional Chief Judicial Magistrate-IIIrd Agra.
After some arguments, learned counsel for the applicants does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction.
Certified copy of the order may be returned to the learned counsel for the applicants after retaining a xerox thereof.
In view of the above, the application is dismissed as not pressed with the aforesaid liberty.
