Sri G.S. Chauhan, learned counsel for the applicants and Sri Tej Bhan Singh, learned A.G.A. for the State are present.

The present application under Section 482 of the Code of Criminal Procedure, 1973 has been filed to quash the order dated 18.09.2023 passed by Additional Civil Judge (Junior Division), Court No. 7/ Judicial Magistrate, Varanasi in Case No. 90769 of 2022, (State Vs. Satya Narayan Sharma and others) arising out of Case Crime No. 152 of 2021, under Sections 419, 420, 409, 120-B of I.P.C., Police Station- Jaitpura, District- Varanasi, whereby the discharge application of the applicant has been rejected.

After some arguments, learned counsel for the applicants does not want to press the application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction.

Certified copy of the order may be returned to the learned counsel for the applicants after retaining a xerox thereof.

In view of the above, the application is dismissed as not pressed with the aforesaid liberty.
