Present application under Section 482, Cr.P.C. has been filed by the applicant to set aside the order dated 3.4.2023 passed by Additional Chief Judicial Magistrate, Court No. 1, Gorakhpur in case No. 192 of 2019, arising out of case crime No. 112 of 2017, under Sections 143, 323, 504, 506, 427, I.P.C., Police Station Shahpur, District Gorakhpur, whereby discharge application has been dismissed.
After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file appropriate application/proceedings before the court of competent jurisdiction.
The instant application is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction.
Office shall return the certified copy of the documents to the learned counsel for the applicant, after retaining a xerox of the same.
