- Heard Mr. Pramod Kumar Srivastava, the learned counsel for applicants and the learned A.G.A. for State-opposite party-1.
- Perused the record.
- At the very outset, the learned A.G.A. has raised a preliminary objection by submitting that the impugned summoning order passed by court below has not been impugned in present application.
- At this juncture, the learned counsel for applicant submits that certified copy of the Cognizance Taking Order/Summoning Order dated 16.08.2023 passed by Chief Judicial Magistrate, Kaushambi is not record at page 24 of the paper book. He therefore contends that an inadvertent error has crept in the prayer clause of this application. He therefore submits that he be permitted to correct/amend the prayer clause of this application.
- Prayer made by the learned counsel for applicants is bonafide. Same is not opposed by the learned A.G.A. Accordingly, it is allowed.
- In view of above, let necessary corrections in the prayer clause of present application be carried out by learned counsel for applicant during course of the day.
