- Heard learned counsel for applicant and learned A.G.A. for the State.
- This application under Section - 482 Cr.P.C. has been filed for quashing of the entire proceedings, including cognizance order dated 04.04.2017 as well as non bailable warrant dated 03.12.2018 of Criminal Case No. 14393 of 2020 (State vs. Kashif), arising out of Case Crime No.436 of 2016, under Sections - 498-A IPC and 3/4 of D.P. Act, P.S.- Kharkaunda, District- Meerut, pending in the court of Additional Chief Judicial Magistrate, Court No.-5, Meerut.
- It has been submitted by learned counsel for applicant that matter relates to matrimonial dispute and both the parties have amicably settled the matter and entered into compromise and thus, the impugned proceedings may be quashed on the basis of compromise arrived at between the parties.
- Whether a compromise has taken place or not can best be ascertained by the court where the proceedings are pending, after ensuring the presence of the parties before it.
