Sri Punya Sheel Pandey, learned counsel for the applicant and Sri Karunakar Siangh, learned A.G.A. for the State are present.
The present application under Section 482 of the Code of Criminal Procedure, 1973 has been filed to expedite the trial of Case NCrime No. 25 of 2020 (State of U.P. vs. Naeem), under Section 376, 504, 506 IPC, P.S. Kotwali, District Mathura within stipulated period, pending in the court of A.C.J.M.-I, Mathura.
Learned counsel for the applicant submits that as per report submitted by Additional Chief Judicial Magistrate, Court No. 1, Mathura, Non-Bailable Warrant has been issued against opposite party no.2/accused,which is pending for execution.
After some arguments, learned counsel for the applicant does not want to press the application and wants liberty to file a appropriate application before the court of competent jurisdiction.
Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.
In view of the above, the application is dismissed as not pressed with the aforesaid liberty.
