Hon'ble Saurabh Shyam Shamshery,J.
S/Sri Kamalesh Kumar Nishad and Ram Awadh Maurya, learned counsel for applicant are not present today, even on earlier date i.e. 18.06.2024 they were not appeared.
Sri Roshan Pal Singh, learned A.G.A. for State submits that impugned order dated 13.12.2019 and application was filed by opposite party No.2 under Section 125 Cr.P.C. was an ex-parte order.
Learned A.G.A. for State further submits that applicant has an alternative remedy available under Section 126(2) Cr.P.C. but the same has not been availed as well as reason for delay has also not been adequately explained.
In the aforesaid circumstances, though counsel for applicant is remained absent still this application is disposed of with liberty to applicant to take remedy available as referred above, however, question of delay will be considered by the concerned Court, if remedy is availed.
