I find merit in the argument of Sri Abhijeet Singh, learned counsel for applicants that impugned order passed under Section 204 Cr.P.C. has not considered that material averments raised in complaint were not supported by the complainant in her statement recorded under Section 200 Cr.P.C. as well as even contents of complaint and statements recorded under Section 202 Cr.P.C. even in brief were not recorded in the impugned order. For reference, the impugned order is reproduced hereinafter :-

पररिवनददियन पपेमवतली कसुमनरिली दनरिन दवपकलीगण ओमपकनश , शलीमतली जयशली , रूपपेश कसुमनरि , शलीमतली दकशन दिपेवली कको पररिवनदि परि तलब करि दिनांदडित करिनपे ककी यनचनन ककी गई हहै। -200 पररियनददियन नपे अपनपे पररिवनदि कपे समथिरन मम स्वनांय कन बयनन अन्तगरत धिनरिन दिनां०प०सनां० तथिन बयनन अन्तगरत धिनरिन -202 दिनां०प०सनां० सनकली पलीडिब्ल्यद - 01 भलीकम्बरि धसनांह पसुत बनबदरिनम व पलीडिब्ल्यद -02 कमलपेश दिपेवली पत्नली भलीकम्बरि धसनांह कको परिलीदकत करिनयन हहै तथिन वररिष्ठ पसुधलस अधिलीकक अललीगढ़ कको ददियपे गयपे पनथिरनपत ककी छनयन पदत , एक दकतन डिनक नकोदटिस ददिनननांदकत -03.06.2023 तथिन आधिनरि कनडिर ककी छनयन पदत दिनधखिल दकयन हहै।

पररिवनददियन नपे अपनपे बयनन अन्तगरत धिनरिन -200 दिनां०प०सनां० मम कथिन दकयन हहै दक मपेरिली शनदिली दवशनल कपे सनथि ददिनननांक -08.12.2021 कको हहई थिली। मपेरिपे पदत ककी ममृत्यसु ददिनननांक - 04.08.2022 कको हहई थिली। मपेरिली सससुरिनल वनललों नपे मसुझपे घरि सपे दनकनल ददियन हहै , जको सनमनन शनदिली मम ददियन थिन , वको भली रिखि धलयन हहै। वनपस नहहीं करि रिहपे हह। थिननपे मम दशकनयतपे ककी परि ककोई कनयरवनहली नहहीं हहई।

- 200 ससुनन एवनां पररिपनदि पत कपे कथिनलों तथिन पररिवनदिली कपे बयनन अन्तगरत धिनरिन दिनां०प०सनां० व गवनहनन पली०डिब्लद० -1 व पलीडिब्ल्यद -02 कपे बयनन अनांतगरत धिनरिन 202 दिनां०प०सनां० कन अवलकोकन दकयन।

पररिवनदि पत तथिन उसकपे समथिरन मम पस्तसुत ममौधखिक सनक्ष्यलों कपे सम्यक पररिशलीलन कपे उपरिनन्त दवपकलीगण ओमपकनश , जयशली , रूपपेश कसुमनरि , दकशन दिपेवली कपे दवरुद्ध धिनरि -406 भननां०दिनां०सनां० कपे अन्तगरत दवचनरिण हपेतसु पथिम दृष्टन मनमलन पनयन जनतन हहै , अततः उन्हम उक धिनरिन मम आहहत दकयपे जननपे कन आनांधिनरि पयनरप्त हहै।

अदभयसुकगण ओमपकनश , जयशली , रूपपेश कसुमनरि , दकशन दिपेवली कपे दवरूद्ध धिनरिन - 406 भन०दिनां०सनां० कपे तहत दवचनरिण हपेतसु आहहत दकयन जनतन हहै। पररिवनददियन अन्दिरि सनत ददिन धिनरिन - 204(2) दिनां०प०सनां० कपे तहत गवनहनन सदचली दिनधखिल करिम एवनां आवश्यक पहैरिवली करिम। बनदि पहैरिवली सम्मन जनरिली हको।

बयनन पररिवनददियन पपेमवतली पसुतली भलीकम्बरि धसनांह सनसनलीगपेटि अललीगढ़ नपे सशपथि बयनन दकयन हहै दक मपेरिली शनदिली दवशनल कपे सनथि हहई थिली। 08.12.2021 कको हहई थिली। मपेरिपे पदत ककी ममृत्यसु 04 Aug 2022 कको हहई थिली। मपेरिली सससुरिनल वनललों नपे मसुझपे घरि सपे दनकनल ददियन हहै। जको सनमनन शनदिली मम ददियन थिन वको भली रिखि धलयन हहै। वनदपस नहहीं करि रिहपे हहै। थिननपे मम दशकनयत ककी परि ककोई कनयरवनहली नहहीं हहई।"

The complainant has not mentioned name of proposed accused persons, therefore, to summon four accused without any assigning reasons would be contrary to provisions of Section 204 Cr.P.C.

Sri Upendra Kumar Pushkar, learned counsel for opposite party No.2 refers contents of complaint that every occurrence has been mentioned therein, however, failed to convince this Court that the same was not supported by statement recorded under Section 200 Cr.P.C.,

In above referred circumstances, since aforesaid impugned order is bereft of requisite reasoning that there are sufficient ground to proceed against the applicants, therefore, impugned order dated 07.02.2024 passed in Complaint Case No.442 of 2023 under Section 406 I.P.C. is set aside and matter is remitted to learned Trial Court to pass fresh order within three months after hearing the complainant.

Accordingly, application is disposed of with aforesaid observation.
