Sri Rajendra Kumar Ojha, learned counsel for the applicants submits that in present case by the impugned order passed under Section 204 Cr.P.C. some of the applicants have been summoned under different offences.

Learned counsel for applicants by referring impugned summoning order submits that learned Trial Court in its operative portion has not assigned any reason that how some of applicants were summoned under different offences, as such it may be a case which would be in teeth of a judgment passed by Supreme Court in Lalankumar Singh and others vs. State of Maharashtra, 2022 SCC OnLine SC 1383.

I have carefully perused the impugned order and I find merit in the above argument of learned counsel for applicants that absolutely no reason has been assigned that there are sufficient ground to proceed against applicants to summon them under different offences, for reference relevant part of it is reproduced hereinafter:

" पररिववाददी कको ससुनवा तथवा पतवावलदी कवा अवलकोकन ककयवा।

पररिववाददी दवारिवा पररिववाद पत मम ककयये गयये कथन कवा समथरन स्वययं कवा बयवान धवारिवा 200 द.प.सयं. मम ककयवा गयवा। पररिववाददी कये कथननों कवा समथरन सवाकदीगण पदी०डब्लल -1 रिवाधयेश्यवाम, पदी०डब्लल-2 कवजयपवाल व पदी०डब्लल० 3 छकोटये नये अपनये बयवान अयंतगरत धवारिवा 202 द.प.सयं० मम ककयवा हहै। उक्त बयवाननों कये अवलकोकन सये पथम दृष्टयवा अकभियसुक्तगण कवायंकत, वदीरिपवाल व धमरससयंह कको धवारिवा452, 323, 504, 506 भिवा०दयं०सयं० व अकभियसुक्त ससुरियेश कको धवारिवा-406, 452, 323, 504, 506 व 325 भिवा०द०सयं० कये अकभियकोग मम तलब ककयये जवानये कवा आधवारि पयवारप्त हह। तदन स ुवारि अकभियसुक्तगण उक्त धवारिवा मम तलब ककयये जवानये यकोग्य हहै।

अकभियसुक्तगण कवायंकत, वदीरिपवाल व धमरससयंह कको धवारिवा-452, 323, 504, 506 भिवा०दयं०सयं० व अकभियसुक्त ससुरियेश कको धवारिवा-406, 452, 323, 504, 506 व 325 भिवा०दयं०सयं० मये तलब ककयवा जवातवा हहै। अकभियसुक्तगण कये कवरुद्ध सम्मन जवारिदी हको। पहैरिवदी अकवलम्ब ककी जवायये। पररिववाददी समस्त सवाकदीगण ककी सलचदी पस्तसुत करिये। पतवावलदी कदनवायंक 14-8-23 कको ववास्तये हवासजरिदी अकभियसुक्तगण पयेश हको। "

So far as other argument of learned counsel for applicants is concerned i.e. that it is a counterblast case, it is not necessary to be taken note of at this stage, considering above discussion.

In aforesaid circumstances, impugned summoning order dated 13.7.2023 passed by Civil Judge (Junior Division)/J.M. Sambhal (Chandausi) in Complaint Case No.319 of 2023 (Bhanu Pratap Vs. Suresh and Others) under Sections 323, 406, 452, 504, 506 and 325 I.P.C., Police Station-Dhanari, District-Sambhal is set-aside and considering that present order is passed without issuing notice to complainant, therefore, matter is remanded back to learned Trial Court to pass a fresh order after hearing the complainant and taking note of Lalankumar Singh (supra).

With aforesaid observation, this application is disposed of.
