For the purpose of seeking interim relief, it is stated that on 07.10.2021 (part of Annexure No.1), Sub Divisional Magistrate, Kaiserganj, District - Bahraich found it appropriate to call the parties in the proceedings initiated under Section 145 of Code of Criminal Procedure, 1973 (in short "Cr.P.C.") in relation to the property situated at Village - Bambhaura, Teshil - Kaiarganj, PS- Jarwal Road, District - Bahraich, and therefore directed the parties to appear on 12.10.2021 at about 10:00 a.m. either personally or through an advocate and on the same date i.e. 07.10.2021, in the same proceedings which were registered as Case No. T202108150307157 (Kamili Devi Vs. Ram Ji Maurya and Others), the same officer in the subsequent order dated 07.10.2021 observed that on earlier date the counsel for the parties were heard, which is apparent from the first line of the order dated 07.10.2021 (part of Annexure No.1) and thereafter he passed the order in exercise of Section 146(1) Cr.P.C..
