Heard Shri Rakesh Kumar Yadav, learned counsel for the petitioner.

Keeping in view the nature of relief sought and the order proposed to be passed, issuance of notice to the opposite parties is dispensed with.

At the outset, learned counsel for the petitioner has made an oral prayer for deleting the name of learned Chief Judicial Magistrate, Court No.16, Sultanpur from the array of opposite parties.

The request is accepted and the learned counsel for the petitioner is directed to incorporate the necessary amendment in the memo of petition forthwith.

By means of the instant petition filed under Article 227 of the Constitution of India, the petitioner has approached this Court for issuance of direction to the learned Chief Judicial Magistrate, Court No.16, Sultanpur, to decide an Appeal No.18 of 2005 under Section 318 & 160 of Uttar Pradesh Municipalities Act, 2016 expeditiously.

A perusal of the order sheet of the case pending in the appeal filed before the learned Chief Judicial Magistrate indicates that the opposite parties have put in appearance on 26.04.2016 but the appeal has repetitively been adjourned at most of the time without assigning any specific reason.

The appellant is suffering because of long pendency of the appeal without proceedings.

Keeping in view the aforesaid facts, the petition is disposed of by issuing a direction to learned Chief Judicial Magistrate concerned to proceed with the Appeal No.18 of 2005 under Section 318 & 160 of Uttar Pradesh Municipalities Act, 2016 expeditiously, without granting any unnecessary adjournment to any of the parties and decide the same expeditiously.
