Heard learned counsel petitioner and Mr. Pravin Kumar Pandey, learned counsel for opposite parties whose power filed today is taken on record.
Petition has been filed challenging order dated 04.05.2024 rejecting petitioner's application for compassionate appointment on the ground that at the time of demise of petitioner's father while in service of the Bank, there was no provision for compassionate appointment which has thereafter been introduced subsequently and applies on dependents of only those persons who have passed away while in service of Bank after 08.02.2014 and since petitioner's father had passed on 18.10.2010, he is not covered by the aforesaid scheme.
Learned counsel for petitioner on the basis of instructions, however, submits that petitioner is in actually in service of the Bank concerned but only on temporary basis and he is not pressing the prayer no. 1 and is placing reliance only on prayer no. 2 for a direction to opposite parties to consider petitioner's accommodation/absorption in the appeal concerned in any regular capacity.
In view of such submission, liberty is granted to petitioner to make a fresh representation with regard to absorption/accommodation on any post in the bank concerned but not on compassionate basis. Such a representation shall be made to the concerned authority which shall be considered and decided in accordance with law within a period of eight weeks from the date a certified copy of this order is produced before the said authority.
With aforesaid directions, petition stands disposed of.
