Heard learned counsel for petitioner, Mr. Anand Dwivedi, learned Counsel for opposite party no.1 and Mr. Babu Ram Shukla, Advocate holding brief on behalf of Mr. Satya Prakash Tiwari, learned counsel for opposite party nos.2 & 3.

The present petition has been filed seeking the following main relief:-

"(a). Issue a writ, order or direction in the nature of Mandamus directing opposite party no.-3 Additional General Manager/ Unit Head Indian Telephone Industries Limited, Doorbhash Nagar, Raebareli, U. P. to pay post-retiral dues total amount of privilege leave encashment payable to petitioner, which are admittedly due on account of holidays available for the values of privilege leave Rs.2,17,814/- and provident fund Rs.7,73,465/along with interst............."

Since consideration of petitioner's grievance would entail factual aspects, without entering into merits of the case, liberty is granted to petitioner to move a fresh representation before opposite party No. 3 i.e. Additional General Manager/ Unit Head, I.T.I. Bhawan, Doorbhash Nagar, Raebareli, U.P. In case such a representation is filed, the same shall be decided within period of six weeks from the date a certified copy of this order is produced before the said authority. In case petitioner is found entitled for the aforesaid benefits, actual payment thereof shall be ensured within a period of six weeks thereafter. The concerned authority shall also consider the aspect of interest on delayed payment.

With the aforesaid directions, the writ petition stands disposed of.
