Heard learned counsel for petitioner and learned State Counsel appearing on behalf of opposite parties 1 to 3. Although notice had earlier been issued to opposite party No.4 which has returned unserved but in view of order being passed, the petition is being disposed of even in absence of opposite party No.4.

Petition has been filed seeking a direction to the opposite parties for release of pension of petitioner along with interest.

It is submitted that petitioner was earlier dismissed from service vide order dated 17th February, 2011 which was challenged before this court in Writ A No. 2666 of 2011 which was allowed on 13th September, 2022. Special Appeal No. 412 of 2022 was thereafter allowed only to the extent that compensation awarded to petitioner was set aside. In the meantime petitioner has superannuated from service on 31st March, 2023 but pension papers are not being forwarded by the management.

Since consideration of petitioner's grievance would entail factual aspects, liberty is granted to petitioner to move a fresh representation before opposite party No. 3 i.e. Basic Shiksha Adhikari, District Faizabad. In case such a representation is filed, the same shall be decided within period of eight weeks after calling for the records from the opposite party No.4 from the date a certified copy of this order is produced before the said authority. In case petitioner is found entitled for the pensionary benefits, actual payment thereof shall be ensured within a period of six weeks thereafter.

With the aforesaid directions, the writ petition stands disposed of.
