Heard Sri Apoorva Tewari, the learned counsel for the petitioner, Sri Prafull Kumar Yadav, the learned Additional Chief Standing Counsel representing the State of U.P. and Sri Waseeq Uddin Ahmed, the learned counsel for New Okhla Industrial Development Authority.

By means of the instant petition filed under Article 227 of the Constitution of India, the petitioner has sought a direction to the State Government for expeditious disposal of Revision No. 3297/77-4-24/145 Appeal/23 as also to restrain the opposite parties from taking any coercive steps against the petitioner till disposal of the aforesaid revision. It has been stated in the petition that the revision is fixed for hearing on 20.09.2024. Meanwhile a news article was published in Hindi daily newspaper Amar Ujala on 05..09.2024 to the effect that an order for sealing of the petitioner's property has been passed by New Okhla Industrial Development Authority.

The learned counsel for the petitioner has submitted that till final disposal of the revision no coercive measures should be taken against the petitioner as the same would defeat the ends of justice.

On the basis of written instructions provided by the General Manager (Planning), NOIDA, Sri Waseeq Uddin Ahmed, the learned counsel for the opposite parties no. 2 and 3 has provided a list of properties regarding which sealing orders have been passed, which does not include any property of the petitioner which is affected by the proceedings pending before the opposite party no. 1. As per instructions provided to the learned counsel for the opposite parties no. 2 & 3, no order for ceiling of any property which is subject matter of the pending revision, has been passed.

In view of the aforesaid written instructions provided to the learned counsel for the opposite parties no. 2 and 3 and the statement made by him before the Court accordingly, the petitioner has no reason to be aggrieved and no ground is made out for making any interference, when the revision is fixed for 20.09.2024 for final disposal.

Accordingly, the petition is disposed of by providing that the opposite party no. 1 shall dispose of Revision No. 3297/77-424/145 Appeal/23 expeditiously, without granting unnecessary adjournments to any of the parties.
