Heard Sri Arvind Pratap Singh, learned counsel for the petitioners and learned AGA.

In view of the proposed order, the notice to opposite party No.2 is hereby dispensed with.

The petitioners have filed this 482 Cr.P.C. petition praying for quashing of the charge-sheet no. 1 of 2023 dated 8.10.2023 as well as summoning order dated 24.11.2023 passed by the Chief Judicial Magistrate, Gonda in Case No. 21020 of 2023 (State of U.P. vs. Angad Pathak and others) whereby the petitioners have been summoned for trial u/s 325, 308, 452, 323, 504 & 506 IPC bearing F.I.R. No. 194 of 2023, P.S. Dhanepur, District Gonda.

At the outset, learned counsel for the petitioners has prayed that the petitioners are ready to surrender before the learned court below and wants to move an application for bail, therefore, direction may be issued to the learned court below for expeditious disposal of bail application of the petitioners.

Learned Additional Government Advocate for the State has no objection to the aforesaid prayer.

Therefore, without entering into merits of the issue, the instant petition is disposed of . However, it is provided that in case the petitioner surrenders before the learned court below within a period of 15 days from today and moves application for bail relating to the aforesaid criminal case, the same shall be considered and disposed of in the light of dictum of Apex Court in re: Satender Kumar Antil vs. CBI and others in Special Leave to Appeal (Criminal) No. 5191 of 2021 with expedition without adjourning the case for any unnecessary reason.
