1. Heard learned counsel for the applicant; learned AGA for the State and perused the records.

2. The present application has been filed seeking anticipatory bail apprehending arrest in FIR No.550 of 2023, under Sections 420, 467, 468, 471, 506 IPC & Section 138 of Negotiable Instruments Act, Police Station Mohanlalganj, District Lucknow.

3. Learned counsel for the applicant argues that one of the co-accused was granted the benefit of anticipatory bail vide order dated 23.05.2024. The present applicant is only the marginal witness of the sale deed. The applicant was granted interim protection by this Court vide order dated 25.07.2024.

4. Learned AGA opposes the bail application.

5. Considering and adopting the reasoning as contained in the order dated 23.05.2024, the applicant is entitled for grant of anticipatory bail on the same terms and conditions as contained in the order dated 23.05.2024. The present application for anticipatory bail is accordingly allowed.

6. In the event of arrest, let the applicant Rabind be released on anticipatory bail till filing of the charge sheet in aforesaid FIR number on his furnishing a personal bond of Rs.30,000/- to the satisfaction of Station House Officer concerned with the following conditions:

(a) The applicant shall make himself available for interrogation by a police officer as and when required and will co-operate with the investigation;

(b) The applicant shall not leave India without previous permission of the Court;

¶13

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence;
