Heard learned counsel for petitioner, learned State Counsel appearing on behalf of opposite parties no.1 & 2 and Mr. Pawan Kumar Sharma, learned counsel holding brief on behalf of Mr. Ram Kumar Singh, learned counsel for opposite parties no.3 and 4.

Petition has been filed seeking a direction to competent authority to consider petitioner's case for regularization in terms of Uttar Pradesh Regularization of Persons working on daily wages or on work charge or on contract in Government Department on Group-'C' and Group-'D' posts (Outside the purview of the Uttar Pradesh Public Service Commission) Rules of 2016 as well as Government Order dated 03.01.2017, in view of the fact that petitioner has been working on daily wage basis with opposite parties since prior to cut off date.

Learned counsel for opposite parties no.2 and 3 however on the basis of instruction submits that the petitioner has been engaged in service through outsourcing and is not on daily wage basis.

Since consideration of petitioner's grievance would entail factual aspects, liberty is granted to petitioner to file a fresh representation before opposite party no.4 i.e. Executive Officer, Nagar Panchayat Mohaan, Unnao or any other competent authority who shall consider and decide same within a period of eight weeks from the date a certified copy of this order is produced before said authority.

With the aforesaid observation, petition stands disposed of .
