"1. Heard Sri Shashi Nandan, learned Senior Counsel assisted by Sri Balram Mishra, learned counsel for the petitioner and Sri Abhishek Shukla, learned Addl. C.S.C. for the state-respondent.
2. Learned Senior Counsel for the petitioner submitted that the petitioner is recorded owner of plot no.230, but the police station concerned, which is situated over the adjacent plot no.232, is making construction over the plot of the petitioner. He further placed reliance upon the report dated 26.11.2019 in order to demonstrate that petitioner is the owner and is in possession of plot no.230.
3. Mr. Abhishek Shukla, learned Addl. C.S.C. placed the instruction dated 24.7.2023 which is taken on record wherein it is mentioned that petitioner is not in possession of plot no.230 rather the said plot is in possession of the police station concerned.
3. Matter requires consideration.
4. Let the counter affidavit be filed by respondent no.2/District Magistrate, Siddharth Nagar for the state-respondents, denying the averments made in the writ petition as well as stating the fact specifically as to how the construction is being made in the plot of the petitioner, within 4 weeks. Petitioner will file rejoinder affidavit within a week thereafter.
7. List on 5.9.2023, before the appropriate Bench.
8. Until further orders of this Court, no construction shall be raised by the respondents over the plot no.230.
9. Registrar (Compliance) is directed to communicate this order to
respondent no.2/District Magistrate, Siddharth Nagar within 3 days for necessary compliance."
