1. Heard learned counsel for the petitioner, Shri Sanjay Kumar Srivastava, learned State Law Officer for the State and Shri Bhupendra Kumar Tripathi, learned counsel for the respondent No. 3-Land Management Committee.

1. The instant public interest litigation has been filed for mandamus commanding the respondents to ensure proper eviction of unauthorized persons over the land in dispute which is a Gaon Sabha Land.

1. Counsel for the petitioner submitted that the proceedings under Section 67 of U.P. Revenue Code, 2006 being Case No. 4337 of 2022, Lekhpal Vs. Alakhnarayan and Arun Kumar (Computerized Case No. T202214360204337) is pending before the respondent No. 2-Tehsildar, Tehsil Badlapur, District Jaunpur.

1. In view of the pendency of the aforesaid proceeding under Section 67 of the U.P. Revenue Code, 2006 against the respondents No. 4 and 5, the instant public interest litigation is finally disposed of directing the respondent No. 2-Tehsildar, Tehsil Badlapur, District Jaunpur to conclude the proceeding of Case No. 4337 of 2022, Lekhpal Vs. Alakhnarayan and Arun Kumar (Computerized Case No. T202214360204337) expeditiously preferably within a period of four months from the date of production of certified copy of this order after affording proper opportunity of hearing to the parties.
