Heard Sri Suman Kumar Yadav, learned counsel for the petitioner, Sri Abhishek Shukla, learned Additional Chief Standing Counsel appearing for the State-respondents and Sri Vijay Bhan Singh, holding brief of Sri Rameshwar Prasad Shukla, learned counsel for the respondent no.4.

The present petition has been filed seeking to raise a grievance with regard to certain auction proceedings stated to have been initiated by the respondent-authorities in respect of a pond/plot no. 151, area 0.967 hectare, situate at Village Barauna, P.S. Bardah, Tehsil Marteenganj, District Azamgarh.

Counsel for the State-respondents submits that pursuant to the previous order instructions have been received from the respondent no.3 indicating therein that auction proceedings in question have been concluded with an order of approval having been granted on 22.12.2022 and in case the petitioner is aggrieved, he may avail the appropriate statutory remedy under the relevant Rules.

Counsel for the petitioner has not disputed the aforestated legal position with regard to availability of a statutory legal remedy and accordingly submits that he does not wish to press the petition and that the petitioner would avail the appropriate legal remedy.

The petition stands disposed of accordingly.
