Heard learned counsel for both the parties.

Sri Lal Chand Yadav, learned counsel for petitioner submitted that the only prayer sought through the instant petition is to carry out the order dated 26.06.1987 passed by respondent no. 4- Assistant Collector, Ist Class, Gorakhpur under proceeding of 229B of U.P.Z.A. & L.R. Act through which property has already been declared in favour of the petitioner.

If that be so, respondent no. 4 is hereby directed to carry out the orders passed by the respondent no. 3 in favour of the petitioner under proceeding of 229-B of U.P.Z.A. & L.R. Act and the entire exercise shall be expedited as early as possible preferably within a period of three months from the date of production of certified copy of this order. However, it is made clear that compliance of audi alteram partem must be ensured while adjudicating the pending application preferred by the petitioner.

Writ petition stands disposed of accordingly.
