Vakalatnama filed by Mr. Brijesh Shukla, Advocate, on behalf of petitioner is taken on record.

The present writ petition has been filed inter-alia with the following prayers :-

"i) Issue a writ, order or direction in the nature certiorari quashing impugned order dated 27.12.2010 passed by the Sub Divisional Magistrate & impugned order dated 23rd April, 2014 passed by the Additional Commissioner Aligarh Division Aligarh Annexure nos. 4&5 to the writ petition).

ii) Issue a writ, order or direction in the nature of Mandamus directing the courts below to decide the application dated 11.09.2009 of petitioner under section 33/39 of the Land Revenue Act filed before Sub Divisional Magistrate Aligarh a fresh treating it to be maintainable ( Annexure no.1 to the writ petition)."

It is argued by counsel for the petitioner that after the aforesaid orders were passed original suit under Section 229-B of the U.P.Z.A. & L.R. Act, 1950 was filed by the petitioner hence a prayer has been made by him to dismiss present petition and permit the petitioner to pursue the suit as stated above.

This prayer has not been opposed by Mr. Vijay Shankar, learned Additional Chief Standing Counsel assisted by Mr. Arvind Kumar Mishra, learned Standing Counsel on behalf of respondent-State and Mr. Kumar Anish, learned counsel for the private respondents.

In view of the same, present petition is dismissed.
